General Conditions of Services
Pc Cube srl is a company registered with the Rome Chamber of Commerce with VAT number IT06832421009 and registered office at Via della Vite 41, Rome. Pc Cube publishes and manages the website leisuredomus.it, a travel booking site and other supplementary services (hereinafter the "Site").
1. Premise
These general terms and conditions (hereinafter the "General Terms and Conditions") define the terms and conditions under which PC Cube allows its customers (hereinafter the "Customer(s)) to benefit from the services, particularly booking services, available on this Site and described in more detail below (hereinafter the "Services").
Before booking a Service on the Site, the Customer declares that (i) he or she is acting for personal purposes that are not part of commercial, industrial, business, professional, or agricultural activities and (ii) he or she has full legal authority to accept these General Conditions.
The Customer is invited to carefully read these General Conditions, whose prior acceptance is mandatory for booking any Service offered on the Site. We recommend that the Customer save and print these General Terms and Conditions using the standard functions of their browser and computer.
Pc Cube reserves the right to modify or supplement these General Terms and Conditions, in whole or in part, at any time. In this case, the new version of the General Terms and Conditions will be available on the Site with the effective date. Customers are advised to consult the General Terms and Conditions regularly to be aware of any changes. In any case, the Customer will be bound only by the version of the General Terms and Conditions in effect at the time the Customer books their Service.
The Customer is required to pay exclusively, where necessary, for the technical means that allow access to the Site.
2. Description of Services
2.1 PC Cube Services
Pc Cube offers on its Site (i) booking services for rooms in apartments or other types of tourist accommodation ("Tourist Accommodation Services") (2.1.1) and (ii) additional services to the aforementioned Services ("Additional Services") (2.1.2).
The Tourist Accommodation Services and the Additional Services are hereinafter collectively referred to as the "PC Cube Services".
2.1.1 Tourist accommodation services
The Site allows you to book rooms in apartments or other types of tourist accommodation operating under the Leisure Domus banner (hereinafter collectively referred to as the "Properties").
The main features, availability dates, price, options offered, payment terms, and specific conditions applicable to the selected rate (guarantee policies, cancellation policies, check-in times, etc.) of the proposed Accommodations are indicated during the booking process referred to in Article 3.
In this regard, it is specified that each Property has its own specific conditions applicable to the selected rate, which are also available on the Website (hereinafter the "Specific Conditions") which are made known to the Customer before booking on the Website. Specific Conditions may include check-in and check-out times, the guarantee policy, cancellation terms, Wi-Fi access, specific conditions applicable to children, and the admissibility of animals, provided they are kept on a leash or caged in the municipality areas of the property.
Finally, pursuant to applicable regulations, upon check-in at the Facility, the Customer may be asked to complete a public safety form. To this end, customers must show an identity document so that appropriate checks can be carried out to determine whether or not it is necessary to complete this form.
2.1.2 Additional Services
The Site also allows the booking of Additional Services, such as breakfast, excursions, etc.
Additional Services may include travel services pursuant to Article 3.1 of Directive (EU) 2015/2302 of 25 November 2015 on package travel and linked travel arrangements. Additional Services and Tourist Accommodation Services may constitute a "linked travel arrangement" or a "package travel" based on the criteria specified in the aforementioned Directive. This information is communicated to the Customer before booking these services in the specific Terms and Conditions of each offer.
2.2 Partner Services
PC Cube enters into partnership and distribution agreements with third-party websites or companies ("Partners") to allow the Customer to search for, select, and book services offered by them (hereinafter "Partner Services"). The terms and conditions applicable to these Partner Services are available from the Partners.
3. Booking Processes
The Customer chooses the Services presented on the Site or those of its Partners by following the process designated for this purpose.
3.1 Booking PC Cube Services
Bookings for PC Cube Services are made by the Customer on the Site.
The booking process varies depending on the Customer's browsing experience and request; It includes the following steps:
- Step 1: Entering the search criteria for a destination, an Accommodation, and, where applicable, one or more Additional Services;
- Step 2: The results and selection of an Accommodation and, where applicable, one or more Additional Services;
- Step 3: The details and characteristics of the selected Service(s), particularly in the case of a Tourist Accommodation Service: the characteristics of the Tourist Accommodation (prestige, room size, TV, minibar, etc.), the length of the stay, the options offered (e.g., breakfast, WIFI access, etc.), the total price of the reservation including the breakdown of applicable taxes, the legal information form in the case of linked tourist services or tourist packages, and the applicable Specific Conditions (cancellation terms, check-in time, etc.);
- Step 4: The reservation summary for the Service(s) with: (i) a summary of the main characteristics (duration of the stay, characteristics of the tourist accommodation service and/or additional service(s), total amount including applicable taxes); (ii) the Customer's data entry: completing all mandatory fields (indicated by an asterisk) with the option to save this information to create an account on the Site;
- Step 5: The Customer completes the booking of the Service(s) by: (i) entering their payment method details, whether partial or full prepayment of the booking is required, or if a booking guarantee for tourist accommodation services is required; (ii) reviewing and accepting the General Terms and Conditions and the Specific Conditions relating to the booking before validation by the Customer;
- Step 6: Confirmation of the booking of the Service(s) by PC Cube and the relevant Accommodation Provider;
- Step 7: A booking confirmation email for the Service(s) is sent to the Customer, detailing the booked Service(s), the price, the Specific Conditions accepted by the Customer, the date of booking, information regarding after-sales service, and the address of the Accommodation Provider where the Customer can submit complaints.
The booking process is considered complete upon receipt by the Customer of the confirmation email.
The Customer may book PC Cube Services on behalf of one or more persons, where authorized by them, and assumes sole responsibility for any operations carried out.
3.2 Booking Partner Services
Bookings completed by the Customer through Partner Services are made via the website, unless otherwise indicated on the website that links to third-party sites.
4. Price and payment
4.1 Price
Prices for booking Services are indicated before, during, and after the booking itself.
For tourist accommodation services, the prices shown are per room for the number of people and date selected.
When confirming a Service booking, the total price shown to the Customer includes all applicable taxes and is expressed in the currency of the Property. It is valid for the duration indicated on the Website.
If the total price of the Service reservation is paid in a currency other than the one confirmed at the time of booking, any exchange fees will be borne by the Customer.
Unless otherwise indicated on the Site, options (such as breakfast, half board, full board, and so on) offered when booking the Service are not included in the price.
The tourist tax, indicated during the Service booking process, must be paid directly to the Facility, except in cases where the relevant amount has already been included in the cost of the stay and paid in advance online.
Prices include VAT in effect on the booking date. If the VAT rate changes, the price indicated on the booking date will be automatically adjusted.
The price indicated on the invoice date will be automatically adjusted based on any changes or introduction of new legal or regulatory taxes imposed by the competent authorities.
Finally, some promotional offers are available only on the Website and sold exclusively online and cannot be claimed after arrival at the property.
4.2 Payment
The customer provides their payment details both (i) for the advance payment of the reservation, (ii) as a booking guarantee, and (iii) as part of the online check-out procedure. They enter their card number directly in the space provided for this purpose (data entry protected by SSL encryption), without spaces between the digits, the expiration date (unless payment is made in advance, the card must be valid at the time of the stay), and the card security code for payments made in advance via the payment platforms listed below.
PC Cube has chosen Stripe (and any other similar services that will be displayed on the Site) to protect online credit card payments. The validity of the card used by the customer for payment is verified by these partners. A credit card may be declined for a variety of reasons: stolen or blocked card, maximum limit reached, incorrect data entry, and so on. In the event of problems, customers must contact their bank and the Property or other entity to confirm the Service booking and the payment method.
The available online payment methods (cards, wallets, and so on) are listed on the payment page of the Site.
In the event of payment to the Accommodation or another entity, each Accommodation or other entity may accept different payment methods. However, the Customer must present to the Accommodation the credit card with which they guaranteed the reservation or made the payment. The Accommodation may also request identification to prevent credit card fraud.
If the Guest has not paid for their stay in advance online, the Property may request a deposit or credit card authorization upon arrival. This request serves to guarantee payment of the amounts related to the services provided by the Property.
In the event of a no-show for a Tourist Accommodation Service reservation guaranteed by credit card, the Facility will charge the customer, as a penalty, an amount equal to the price of the first night to the credit card provided to guarantee the reservation. Reservations for all other nights will be canceled without charge, unless otherwise specified in the Specific Conditions.
When prepaying, the total amount charged for the reservation includes: the price indicated at the time of booking and any applicable taxes and, where applicable, the prices of the options selected by the Customer.
4.3 Check-in and check-out online
To facilitate and expedite the Customer's departure from the Property, PC Cube may adopt, where permitted by local regulations, a procedure that allows for digital check-in and/or check-out before the stay.
Online checkout requires a request to the Guest's bank. The Property will charge only the actual invoice amount from the date of arrival until the end of the Guest's stay, without the need for the Guest's physical presence or revalidation.
The authorization request amount includes the reservation amount (or the remaining amount in the case of partial prepayment at the time of booking) and an amount to cover any on-site consumption or expenses (breakfast, if not included in the rate, restaurant, bar, tourist tax, where applicable, and so on).
If the customer has prepaid for the stay upon arrival, any additional expenses at the property must be paid directly upon use of the service.
If the reservation is canceled after the authorization request has been activated, a request to cancel the authorization request will be automatically sent to the bank of the credit card holder used.
5. Cancellation or modification of a Service booking
Where the Specific Conditions allow it, cancellation and modification of a Service booking can be made directly on the Site via the "Modify or Cancel Booking" section.
In the event of a Service interruption by the Customer, the total agreed price will be charged.
In the case of tourist accommodation services, unless otherwise specified in the specific Terms and Conditions, the Customer must vacate the accommodation before the time indicated by the Terms and Conditions, generally by 12:00 noon on the last day of the reservation. Otherwise, the Customer will be charged for an additional night.
6. Customer Commitment and Responsibility
The Customer is solely responsible for choosing the Services on the Site and ensuring their suitability for their needs; PC Cube assumes no liability in this regard.
The Customer is also responsible for the information provided when creating the account and/or booking a Service. PC Cube is not liable for any incorrect or fraudulent information provided by the Customer. Furthermore, the Customer is solely responsible for the use of the account and bookings made, in his/her name and on behalf of third parties, including minors, unless it can be clearly demonstrated that the fraudulent use is not attributable to any fault or negligence on his/her part. In this regard, PC Cube must immediately notify Customer Service of any improper or fraudulent use of his/her email address.
The Customer undertakes to use the Site and the Services offered in compliance with applicable legislation and these General Terms and Conditions. In the event of failure to fulfill the obligations established under these General Terms and Conditions, the Customer is liable for any damages caused by him/her to PC Cube or third parties. To this end, the Customer undertakes to indemnify PC Cube from any claims, actions, or recourses of any kind that may arise therefrom and to reimburse it for any related damages, costs, or indemnities.
In particular, the Customer undertakes, by making a binding reservation for a Service, to pay the price and comply with the specific and related Conditions. Indeed:
- Any reservations or payments deemed irregular, ineffective, incomplete, or fraudulent for reasons attributable to the customer will result in the cancellation of the Service reservation at the customer's expense, without prejudice to any action that PC Cube may take against the Customer.
- Any behavior contrary to morality and public order at the Facility, as well as failure to comply with the Facility's internal regulations, will entitle the Facility manager and/or any other Service provider to require the Customer to leave the Facility, without this giving rise to any compensation and/or refund, if payment has already been made. If payment has not yet been made, the Customer must pay for the Services consumed before leaving the Facility.
- The Customer also undertakes to ensure that the IT resources made available to the Facility (particularly the WIFI network) are not used in any way for the reproduction, representation, making available, or communication to the public of works or objects protected by copyright or similar rights, such as texts, images, photographs, musical works, audiovisual works, software, or video games, without the authorization of the rights holders, if such authorization is required. The Customer is also required to comply with the security policy of the Facility's Internet access provider, including the rules for using the protection measures implemented to prevent the illicit use of IT resources, and to refrain from any action that could undermine the effectiveness of such measures.
7. Pc Cube's Commitment and Responsibility
Pc Cube undertakes, as part of a best efforts obligation, to provide access to the Site and the Services proposed in compliance with the General Conditions, to act with diligence and competence, and to make every effort possible, within reasonable limits, to correct any malfunction of which it becomes aware.
However, PC Cube may find it necessary to temporarily suspend partial or total access to the Site, particularly for technical maintenance reasons, without this being its responsibility.
The Customer acknowledges and agrees that PC Cube shall not be held liable for any inconvenience or damage related to the use of the Internet, including, for example:
- incorrect transmission and/or reception of data and/or information over the Internet;
- failure of the receiving device or communication lines;
- any malfunction of the Internet network that prevents the proper functioning of the Site and/or the booking of Services.
The Site may contain hyperlinks to other websites published and operated by third parties. PC Cube declines any responsibility for the content of such websites and the services offered therein. In this regard, please note that partners are responsible for promoting the offers posted on their websites. Any consultation of third-party websites is under the sole responsibility of the Customer.
PC Cube may act as an intermediary between a Facility and the Customer, who expressly acknowledges and accepts this condition. In this regard, PC Cube will have a mandate regarding the negotiation, training, and marketing of PC Cube Services at the Facilities. It is specified that the Facilities may be managed by entities legally separate from PC Cube.
In the event of disputes and/or complaints relating to a stay at a Property or the booking of a PC Cube Service, the Customer acknowledges and agrees to address exclusively the parties managing the Property where the Customer stayed. In this regard, the Customer may in no way attribute liability to PC Cube for shortcomings attributable to Properties not directly managed by it.
8. Force majeure
Neither party shall be held liable for any failure to fulfill its contractual obligations due to force majeure. It is expressly agreed that an event of force majeure suspends the fulfillment of mutual obligations for both parties and that each party shall bear the burden of any resulting costs. Cases of force majeure are considered to be those events normally recognized as such by case law. If the force majeure event lasts more than thirty (30) days from its onset, these General Terms and Conditions may terminate for any of the aforementioned parties without either party being entitled to claim damages.
In the event of force majeure or any other exceptional event that prevents the provision of the Service, and in particular the provision of the Guest's room, the Guest may reserve the right to accommodate the Guest, for the entire duration of the stay, or only for part of the stay, at a Guesthouse of an equivalent category or to provide a Service of the same nature, subject to the Guest's prior acceptance.

10. Privacy and personal data protection
When the Customer uses the Site, particularly when making a reservation, Pc Cube processes the Customer's personal data in accordance with the provisions of the Privacy Policy.
11. Other
The General Terms and Conditions are governed by Italian law, without prejudice to any mandatory protection provisions that may be applicable in the consumer's country of residence.
Should a dispute arise regarding these General Terms and Conditions, PC Cube will inform the Customer of the possibility of resorting to traditional mediation or other out-of-court settlement procedures, in accordance with the conditions established by Italian law.
Guests are required to contact customer service or the Property first to attempt to resolve the dispute amicably. PC Cube also informs the Customer of the existence of a European platform for online dispute resolution, which they can use.
